Williams ORDINANCE NO. 10572 AN ORDINANCE CLOSING AND ABANDONING AN ALLEY LOCATED SOUTHEAST FROM THE SOUTHERN RAILROAD, BETWEEN BENNETT AVENUE AND EAST 12TH STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned an alley located southeast from the Southern Railroad, between Bennett Avenue and East 12th Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: A 9.6 foot wide unopened alleyway beginning on the southeast line of the Southern Railway right-of-way 135 feet southwest of the intersection of the southeast line of the Southern Railway right-of-way with the southwest line of Bennett Avenue, and extending southeast 310 feet between parallel lines to the northwest line of a 10 foot alleyway. Said 9.6 foot alleyway separates lots 13-19, block 2, from lots 20-26, block 2, Montague's Addition No. 3 to Highland Park, as shown by plat of record in plat book 4, page 11, ROHC. Tax Map No. 146O-B-25-29. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The reservation for Jupiter Industries, Inc., d/b/a Chattanooga Gas Company, of an easement the width of the streets for its gas main, lines and other distribution facilities located within the petitioned right-of-way, which must be maintained for the use and benefit of its customers. 2. The areas reserved for utility easements must be kept free and clear of all structures. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
